Gilmore is a historical case, in that he was the first man to be executed after the U. S. Supreme Court reinstated the death penalty, and because he refused all appeals to which he was legally entitled.

Gilmore was asked to choose between being hanged or shot by a firing squad. He chose the latter, believing that a hanging could easily be botched.
