They are not the same. The fact that some people use the terms incorrectly doesn't mean the definitions have changed. Do some reading here:
Bavarian cream - Wikipedia, the free encyclopedia
Custard - Wikipedia, the free encyclopedia
There is no way to answer whether "they" all do the same thing without asking them all.
Would bav. Cream have a liquor in it? I think I had some and didn't like bav. Cream bec. Of the flavor?

The donut shops around here all say bav. Cream is the same as custard. Same filling not two different things. Grandma wants a true custard donut and now being told bav. Cream is it when she says its not? Does any one know if they make a true custard or is it all bav. Cream these days? ...thanks
Yes it would. I laughed so hard when I read that that I started coughing and nearly peed myself. It can have different types of alcohol in it. A different spirit would have a different flavor.
Worked in Bakeries for years, married a baker...the "Bavarian Creme" in donuts and cakes comes out of the same bag as the custard, sometimes they would add an imitation alcohol flavor to make it a bit different. The only difference is the name printed on the product.
Thanks for that PF.
Yup, it changes from village to village in the Black Forest. Some even add cream cheese (quark) up in Triberg where all the Kockoo Clocks come from. It differs from town to town. One baker, used to mixed extra whipped cream into the custard and called THAT Bavarian Cream.
